Glenn Greenwald is able to use the large picture as a lens to focus on a specific event or problem better than any other writer I am aware of. But he, like all writers, has his limitations, and they really pop out in his Jan28 The Intercept piece about DTDuck imposing a “Muslim ban” with the Jan27 Executive Order. Nevertheless, Glenn Greenwald is Glenn Greenwald, which means the piece is superbly organized and his thoughts and concerns are stated with crystal clarity.  Anything this guy writes is a good read, even if you don’t agree with all of his assertions.

The Ryoko-registry: Murder Victims Decide the Death Penalty Question

Liliana Sergura at The Intercept has posted a must-read article on the two death-penalty propositions Californians will vote on next Tuesday: Prop 62 takes the death penalty off of the table entirely; Prop 66 puts post-sentencing proceedings in death penalty cases on a fast track. 

With these two mutually exclusive propositions, the issue of how California deals with its muddled death sentence situation could not be placed before the voters more clearly. The almost 800 convicted murders on California’s death rows will be sleeping uneasily from now until next Wednesday morning.

But, as is virtually always the case with important policy issues, California’s either-or options and the wholly-within-the-box thinking eclipse and, ultimately, obviate discussion of more imaginative solutions to these incredibly difficult moral questions, such as: Who should determine whether or not a convicted murderer pays with his/her life? And how can those decisions be made in a way that filters out bias due to the gender, race, and ethnicity of the murderer?

Criminal lawyers deal with Nino Scalia’s opinions and dissents on a regular basis, and will understandably have an ambivalent emotional reaction to his death because Scalia could occasionally lean as far to the left as he did to the right. But I wonder how many of the millions of accused who have been even more directly affected by Nino’s views on the 4th, 5th, and 6th Amendments ever recognized the role he played in their lives. I was one of those, in an off-handed sort of way.

In conclusion, I don’t understand why Uncle Al didn’t just say “I don’t know the lady, have never met her, and have never knowingly laid eyes on her, certainly not when she was a minor.” That would have covered it as far as the JD #3 allegations go. In the absence of that blanket denial, I, personally, don’t think this affidavit means squat. If the court grants his motion to intervene, he will positively be deposed, and, boy, would I like to be at that deposition. My guess is that now that he’s got the media’s attention with his shambles of a declaration he will withdraw his motion to intervene in order to avoid a nasty deposition. Just guessin’.  – Denis O’Brien
